UdayBharat - Terms and Conditions
Welcome to UdayBharat. By downloading, accessing, or using the UdayBharat mobile application or website, you agree to be bound by the following Terms and Conditions. Please read these carefully, as they govern your rights and obligations. If you do not agree, you must not use the Platform.
1. Services
UdayBharat provides an online marketplace connecting customers with Restaurant Partners and Delivery Partners. We do not manufacture food or guarantee its quality; we facilitate ordering, payment, and delivery.
2. Orders, Cancellations & Refunds
Once an order is placed and accepted, cancellation is only permitted before food preparation begins. Refunds, if applicable, will be processed within 7 business days through the original payment method. No refunds will be provided once the food has been prepared or delivered unless the order could not be fulfilled by the Restaurant Partner.
3. Delivery & Risk of Loss
Delivery times are estimates and may vary due to factors beyond our control such as traffic, weather, or vendor delays. Risk of loss passes to the customer upon delivery at the address provided.
4. Responsibilities of Restaurant Partners
Restaurant Partners shall comply with all applicable food safety and hygiene laws including the Food Safety and Standards Act, 2006. They are solely responsible for the quality, safety, legality, and preparation of food. Restaurant Partners agree to indemnify UdayBharat against any claims arising from unsafe or unlawful food products.
5. Responsibilities of Delivery Partners
Delivery Partners must comply with applicable traffic, motor vehicle, and labor laws. They must ensure safe and timely delivery. UdayBharat is not liable for any acts or omissions of Delivery Partners beyond its control.
6. Payments
All payments must be made through the secure payment gateways provided on the Platform. UdayBharat reserves the right to withhold or reverse transactions in cases of suspected fraud or violation of law. Prices displayed include applicable taxes and delivery charges.
7. Prohibited Activities
You agree not to misuse the Platform, including but not limited to: hacking, fraudulent transactions, creating multiple accounts to misuse offers, reverse engineering the Platform, or using it for unlawful purposes.
8. Intellectual Property
All content, trademarks, logos, and designs on the Platform are the property of UdayBharat or its licensors. You may not copy, modify, distribute, or commercially exploit the Platform’s content without written consent.
9. Limitation of Liability
UdayBharat shall not be liable for any indirect, incidental, or consequential damages including loss of profits, business interruption, or data loss. Our liability, if any, shall be limited to the value of the disputed order.
10. Indemnity
You agree to indemnify and hold harmless UdayBharat, its affiliates, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, or infringement of third-party rights. Any dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with an arbitrator appointed by UdayBharat. The courts at Ranchi, India shall have exclusive jurisdiction.
11. Termination
UdayBharat reserves the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or as required by law.
12. Changes to Terms
We may update these Terms from time to time. Updates will be posted on the Platform with the effective date. Continued use after updates constitutes acceptance of the revised Terms.
